Thank you for choosing Two Hearts Photography. By booking our services, you agree to the following Terms and Conditions. These terms are designed in alignment with the Child Safety Reforms introduced in Queensland as of 1 September 2025. Please read them carefully.

1. Booking, Consent, and Payment

Kindy and Child Care Photography

• Mandatory Pre-Registration and Informed Consent
  Prior to photographing any child, a parent or legal guardian must complete the pre-registration/consent form available on our website. No photography will occur without completed consent in accordance with child safety regulations.
• Scope of Consent
  By completing the registration:
  • You provide informed, written consent for your child to be photographed.
  • You agree to the temporary secure storage of your child’s photos for up to 12 months to allow for late orders. After this period, all images will be securely deleted.
  • You may withdraw consent at any time by contacting us in writing.
• Image Editing
  Two Hearts Photography will edit our photography, however, will not specifically retouch or alter a child’s appearance in photographs (e.g. blemish/scratch removal) unless explicitly requested in writing by a parent or guardian. An additional fee may apply for this service.
• Payment
  • Payment must be received in full before orders are processed or delivered.
  • Late orders are accepted; however, a late handling and postage fee will apply.
  • Prices and products are subject to change without notice.

All Other Photography Services

• A deposit is required to secure your booking.
• Full payment must be received before final delivery of any images or galleries.
• Payments can be made via bank transfer (details provided upon booking).

2. Cancellations and Rescheduling

Kindy and Child Care Photography

• If you need to cancel or reschedule your child’s photo day, please contact us immediately via email.
• Rescheduling is only possible if additional photo dates are scheduled at your child’s centre.

All Other Photography Services

• Deposits are refundable only if no reschedule is possible.
• If the service has already been provided, the deposit is non-refundable.

3. Photo Sessions – Child Safety and Wellbeing

Kindy and Child Care Photography

• Parents should ensure children arrive on time. Late arrivals must be communicated immediately.
• Specific instructions (e.g., hairstyle, outfit changes) should be provided via the registration form.
• Class photos are typically taken between 10:00 – 10:30 am. Ensure your child is present and prepared.
• Wellbeing Comes First
  In compliance with child safety legislation:
  • Two Hearts Photography will not proceed with individual sessions if a child is visibly distressed, anxious, or unwilling to participate.
  • We aim to create a gentle, child-centred environment and work closely with educators, but we will never force participation.
  • Group/class photos will proceed as scheduled. If a child chooses not to participate, this will be respected.

4. Image Rights and Usage

Kindy and Child Care Photography

• At registration, you will be asked to indicate whether you consent to your child’s image being used for promotional purposes (e.g., website, flyers, brochures).
• No images will be used in marketing without consent.
• Purchased images are for personal use only and may be shared on social media or printed at home.
• Class photos are available in print format only for privacy and safety reasons.

All Other Photography Services

• A signed social media and promotional image waiver is required for public use of images.

5. Image Delivery and Access

Kindy and Child Care Photography

• A watermarked online gallery will be provided for image selection.
• Final edited prints will be delivered to your child’s centre.
• Digital images will be delivered via a secure download link.
• Requests for additional editing or enhancements may incur extra charges.

6. Liability and Safety Compliance

• Two Hearts Photography operate under strict compliance with the Queensland Child Protection Act and National Quality Framework.
• While all care is taken during sessions, we accept no liability for injuries, damages, or losses incurred during photography sessions.
• In case of unavoidable disruptions (e.g., weather, illness, equipment failure), we will offer to reschedule or refund a deposit, if paid.

7. Privacy and Data Protection

• Two Hearts Photographys full Privacy Policy is available on our website.
• All personal and child-related information is handled in accordance with the Privacy Act 1988 (Cth) and Queensland child safety legislation.
• Information collected is strictly used for communication, service delivery, and image processing.
• We will never share your information or your child’s images with third parties without explicit permission.

8. Acceptance of Terms

By registering your child or booking any photography session with Two Hearts Photography, you confirm that:

• You have read, understood, and accepted these terms and conditions.
• You understand your rights regarding image use and data privacy.
• You are aware of your rights to withdraw consent at any time by contacting us.
